Commissions - Terms and Conditions

Style and Work:

  • The drawings are created using graphite and can include minimal coloured parts. Full drawings using colouring pencils are not accepted, therefore the work will be fully in a monotone palette, with possible small, coloured accents. This needs to be agreed during the initial stages of communication.

  • My style focuses on realism/hyperrealism. Other styles will not be accepted (e.g. Comic, cartoon, anime. etc)

  • Commissions that include NSFW topics (e.g. Extreme graphic and violent content, pornography) or offensive content (e.g. racism, sexism, etc) will not be accepted.

  • Digital commissions are not accepted – all my commissions are created on paper. This client will receive the original piece of paper as a final product that will be send via mail.

  • Any questions regarding the topic will have to be discussed during the initial stages of communication.

Requirements:

  •  For each commission, I will need one or more high-quality images of the subject(s) and a description of what the outcome should be. Multiple images can be used, and I will create a composition from them. This composition will be agreed by the client before I start the drawing.

    • The time assigned to create said composition, if needed, is already included in the final price for the drawing.

  • Once the image and/or composition have been agreed upon, revisions will not be allowed (merely based on the kind of medium I use). If you wish for any changes in the composition, this has to be communicated early in the process as no changes will be made to it after the agreement has been made.

  • While the content of the drawing remains to be the client’s property, I, as the artist, retain the rights to the drawing. The drawing cannot be replicated/duplicated for commercial purposes without my consent unless this is agreed during the initial stages.

  • All communication between client and artist will be through email. If conversations are started over social media (e.g. Instagram) or other methods, I will ask the client to transfer the conversation to email. The only email used for commissions is _artbyrafaela_@sapo.pt. Do not respond to emails from different addresses as they will not be from me.

  • If there is an issue with this mean of communication, please mention it during the initial stages of communication.

Pricing:

  • The basic pricing is the following:

    • Pets (A4): from 100€ for 1 pet, 20€ per additional pet (up to 2 pets in one drawing)

    • Pets (A3): from 175€ for 1 pet, 30€ per additional pet (up to 3 pets in one drawing)

    • People (A4): from 200€ for 1 or 2 people, 50€ per additional person (up to 3 people in one drawing)

    • People (A3): from 350€ for 1 or 2 people, 70€ per additional person (up to 4 people in one drawing)

  • Pricing may vary depending on number of faces, difficulty of image, and additional requests (e.g. Colour accents, backgrounds, etc).

  • Please understand that I consider the placement of people before I start a drawing. As stated before, a different composition may be necessary. If needed, the composition for the final piece will be sent to the client for approval before the drawing is started.

  • Each commission works in a first-come-first-served manner. Unfortunately it is not allowed to skip the line.

  • A minimum of 75% of the commission must be paid upfront for the commission to be started. The remaining 25% will be paid once the commission is completed and approved by the client. The commission will not be mailed until the amount is paid and received by me in full. Please always account for what day of the week it is when sending money - most banks don’t send money during weekends/bank holidays.

  • The money will be received onto a PayPal account - make sure your bank allows for PayPal transfers before requesting a commission.

Time-Related Information:

  • A commission can take 1-4 months to complete, depending on its size and contents. An average for a specific piece will be discussed during the initial stages of communication.

  • If, for any reason, this time needs to be extended by me (the artist) the client will be made aware through the appropriate way of communication.

  • The client will be contacted with updates whenever I find it is necessary. If the client wants additional updates, this can be communicated to me, and I will be more than happy to provide extra updates on their work.

  • I as the artist retain all rights to cancel a commission at any point. The client will be made aware through the appropriate way of communication. Cancelling a commission is always a last resort.

  • If I, the artist, need to cancel a commission, the money paid upfront will be refunded back to the client to the account that it was sent from. If the client wants the money to be sent back to a different account, I need to be made aware of this as soon as possible.

  • If the client decides to cancel a commission, this should be communicated to me as soon as possible. The money paid upfront will not be returned unless I haven’t started the commission yet.

Social Media:

  • Unless the client mentions their disagreement beforehand, any photographs/videos of the commission will be used as self-marketing on my social media sites. This does not include the original images sent over by the client; only the photographs and videos of the drawing taken by me, the artist.

  • If the client opposes to the sharing of such media, it must be mentioned to me during the initial communication stages.

  • I as the artist am not responsible for any problems that arise from the sharing of said photographs/videos, if this information is not given to me prior to the fact. If it is not communicated to me that the clients would rather not have their commission shared online, then I will assume that sharing said content on my social media accounts for self-marketing purposes is allowed.

  • I will be happy to revise any online posts that are shared featuring the commission, but I do not promise to delete/hide said posts. If I am not informed by the client that they would not like this content to be shared, as stated above, then I, as the artist, will have the final say on what is shared about the commission on my social media accounts.
